The West Virginia Picture

West Virginia is a deliberately light-touch state on artificial intelligence, and I want to be precise about what that means for anyone building or deploying AI products here. There is no comprehensive AI statute on the books, no risk-tiered regulatory regime, and no general algorithmic accountability or bias-audit mandate. What West Virginia has instead is a study-first posture. The Legislature created the Task Force on Artificial Intelligence in 2024 and expanded it in 2025 to cover economic opportunity and annual reporting, with the task force scheduled to run through July 1, 2027. The clear signal is that West Virginia intends to learn before it legislates, working through the Office of Technology rather than rushing a broad statute. Builders should read the annual task force reports, because they are the leading indicator of where any future binding rules will come from.

Where West Virginia has acted decisively is in criminal law, not commercial regulation. SB 198, signed in April 2025, expanded the definition of child pornography to include AI-generated and digitally synthesized depictions of minors, real or fictional, with felony penalties. This is the one place where West Virginia moved quickly and aggressively, and it is consistent with a national wave. In the 2026 session, SB 154 was introduced to extend this further by criminalizing the insertion of an actual minor's image into explicit content, but as of June 2026 that bill remains pending in the Senate Judiciary Committee and is not law. Builders working on image generation, face-swap, or synthetic media tooling must treat West Virginia's CSAM statute as a hard, enforced line.

On elections and political deepfakes, I want to be unambiguous because this is where misinformation circulates. West Virginia does not have an enacted election-deepfake disclosure law. SB 484, which would have required disclosure of AI-generated political media, failed in the 2025 session. That said, the absence of a deepfake-specific statute does not mean a free pass. Existing West Virginia law on impersonation, fraud, deceptive practices, and election integrity still applies to AI-generated audio, video, and imagery used to mislead voters or impersonate public figures.

For builders, the practical compliance map is short but real. First, anything touching minors and sexual content is governed by a strict criminal statute, and a stricter one may follow, so robust CSAM detection, blocking, and reporting are non-negotiable. Second, there is currently no general AI consumer-protection, transparency, or bias-audit obligation specific to West Virginia, so the binding constraints are the state's generally applicable consumer protection, fraud, data security, and election laws.
