Alaska AI Legislation in 2026
Alaska passed an AI-generated CSAM prohibition through the House unanimously (39-0). Currently in Senate committee.
The Alaska Picture
Alaska sits at the far light-touch end of the American AI policy spectrum, and as of June 2026 the practical answer for builders is simple: there is no comprehensive Alaska AI statute, and there is no enacted Alaska law that imposes AI-specific obligations on the private sector. Every AI-specific measure the 34th Legislature has taken up remains a bill or a resolution, not a law. Because Alaska runs a two-year session, the 2025 introductions are still alive heading into the back half of 2026, but momentum has been narrow rather than broad. The state has chosen to watch and study rather than legislate, formalizing that posture through a legislative task force rather than a regulatory framework.
The one place where Alaska is moving with real urgency is the protection of children. HB 47 is the AI bill to watch. It cleared the House unanimously, 39 to 0, in February 2026 and is now before the Senate. If it becomes law, it would criminalize AI-generated child sexual abuse material at the state level and, notably for technology companies, would attach civil penalties of up to one million dollars per instance to AI organizations that facilitate the creation of such material. That facilitation-liability provision is the single most consequential exposure for AI developers and platform operators in the entire Alaska landscape, and any company offering generative image or video capabilities to or from Alaska should track its Senate progress closely.
By contrast, the broader AI governance vehicle, SB 2, has stalled. It would have layered together election deepfake disclosure, mandatory state-agency AI inventories, and impact assessments, and it would have given Alaska some of the stricter government-AI accountability rules in the country. But it has not moved out of its first committee since early 2025, and a comparable predecessor bill from the prior legislature died entirely. The realistic read is that Alaska is unlikely to enact election deepfake disclosure or government AI inventory mandates this session. Builders should not assume an Alaska deepfake disclosure obligation exists, because it does not.
On government's own use of AI, Alaska's signal is pro-adoption, not restraint. Governor Dunleavy's Administrative Order No. 360 directs state agencies to deploy AI for efficiency, permitting, and deregulation, and the Legislature's task force is oriented toward evaluating opportunity as much as risk. What builders must do in Alaska is therefore less about Alaska-specific compliance and more about discipline: comply with existing general law, prepare for HB 47's child-safety and facilitation-liability rules in case they pass, and avoid relying on any assumption that Alaska has enacted AI transparency, bias, or disclosure requirements, because it has not.
