EU AI Act implementation, 2026
Sweden has not yet enacted its AI Act complementary law: the October 2025 inquiry (SOU 2025:101) proposed PTS as coordinating market surveillance authority, single point of contact and sandbox host, but no bill had followed by October 2026, so the government bridged the gap with interim agency assignments valid until 31 December 2026.

Key findings
- Sweden has a detailed blueprint (SOU 2025:101) but no bill: no lagrådsremiss or proposition had been published by October 2026.
- The government plugged the Article 70 gap administratively in June 2026 by assigning PTS and other agencies interim competent-authority roles until 31 December 2026.
- PTS as the central AI regulator is contested - labour-market stakeholders want IMY to take workplace high-risk AI.
- No national penalty or intervention powers exist yet; the inquiry's sanction regime awaits legislation.
- The PTS-hosted sandbox is mandated on an interim basis but has not launched.

regeringen.se (opens in new tab)No national penalty rules under Article 99 are in force; regulators rely on existing powers.
SOU 2025:101 proposes at least one AI regulatory sandbox established by PTS with other authorities participating in individual projects, originally targeted for 2 August 2026. The June 2026 interim assignment tasks PTS with setting up a national sandbox, but no launch, call or timeline was found as of October 2026.

Inquiry report SOU 2025:101 delivered
The AI Regulation Inquiry reported on 6 October 2025 to the Ministry of Finance, proposing one complementary act and one ordinance, eleven market surveillance authorities coordinated by PTS, two notifying authorities, sanction and intervention powers, secrecy rules and a PTS-run sandbox, all to apply from 2 August 2026.

Consultation closes; PTS and unions raise objections
Responses to the remiss (listed on regeringen.se under 11 November 2025) were due in early 2026. PTS's response reportedly welcomed the proposals but flagged mandate, funding, limitation periods for fines and secrecy gaps; Unionen and Saco reportedly argued IMY (and Arbetsmiljöverket) should supervise workplace high-risk AI instead of PTS (responses not re-read this pass).

Government issues interim assignments to PTS and other agencies
Announced 16 June 2026: PTS acts as national competent authority, market surveillance authority for certain prohibited and high-risk uses, single point of contact and sandbox establisher, alongside other designated authorities, until 31 December 2026 while the law is prepared.

Digital Omnibus on AI changes the deadlines Sweden was working to
Regulation (EU) 2026/1744 (in force 27 July 2026) postponed Annex III high-risk obligations to 2 December 2027 and the sandbox deadline to 2 August 2027, easing pressure on the delayed Swedish framework.

2 August 2026 passes without the complementary law
The inquiry's intended application date for the Swedish act came and went with no lagrådsremiss or proposition published on regeringen.se; the SOU page still lists no follow-up documents.

Analysis
Sweden followed its standard legislative method - a government inquiry, a consultation round, then a bill - and the method has not yet delivered. The AI Regulation Inquiry's report, SOU 2025:101 'Anpassningar till AI-förordningen', was handed to the Ministry of Finance on 6 October 2025 and proposed a single complementary act plus ordinance, a system of eleven market surveillance authorities coordinated by the Post and Telecom Authority (PTS), Swedac and the Medical Products Agency as notifying authorities, administrative fines and intervention powers applicable to private operators and public authorities alike, and a PTS-run regulatory sandbox. Everything was to apply from 2 August 2026.
Consultation closed in February 2026 with broad support for the structure but real friction over PTS's role: PTS itself questioned its mandate and funding, and unions argued the privacy regulator IMY should supervise workplace and education high-risk AI. By June 2026 it was clear the law would not be ready, and on 16 June the government issued interim assignments making PTS the national competent authority, single point of contact and sandbox establisher - together with other designated agencies - until 31 December 2026. This gives Sweden a functioning contact point and nominal surveillance authorities for the Commission's purposes, but assignments cannot create fine powers, so Article 99 enforcement is not possible.
As of October 2026 the regeringen.se record for the SOU still shows no lagrådsremiss or proposition. With the interim mandate expiring at year-end, the government will either need to extend it or table the bill in the 2026/27 session. The Digital Omnibus on AI, which delayed the heaviest obligations to December 2027 and the sandbox to August 2027, means Sweden can still enact its framework before high-risk enforcement begins, but on the verification date it is a partially ready, administratively bridged system rather than a legislated one.
