EU AI Act implementation, 2026

Poland enacted the Act of 3 July 2026 on Artificial Intelligence Systems (Dz.U. 2026 poz. 1003), in force since 11 August 2026, creating a new regulator (KRiBSI) whose chair was appointed in September 2026; inspection, proceedings and penalty chapters apply from 28 October 2026 and the regulatory sandbox is in preparation.

Key findings

  • Poland is one of the few member states to create a brand-new AI regulator rather than reuse an existing body; KRiBSI is both market surveillance authority and single point of contact.
  • The Act is in force (11 August 2026) and the chair is appointed, but the enforcement chapters only apply from 28 October 2026, so sanctions were not yet usable on the verification date.
  • Designation came roughly a year after the 2 August 2025 deadline; the AI Act's prohibitions and GPAI rules applied in Poland for a year without a national enforcer.
  • The sandbox has a statutory basis and a free-for-SME model but is still being built; Poland has until 2 August 2027 under the Omnibus.
  • Poland's national AI policy is outdated (2020); a 2030 successor is still a draft.

National rules on penalties under Article 99 have been laid down.

Regulatory sandbox Planned

The Act empowers the KRiBSI chair to establish regulatory sandboxes, free of charge for micro, small and medium enterprises and with preferential fees for local government. The Ministry of Digital Affairs said after signature that technical preparation had begun and that a sandbox would be set up within roughly four months; no operational launch was confirmed as of October 2026.

Notable developments

  1. Council of Ministers adopts the AI systems bill

The government adopted the draft Act on AI Systems on 31 March 2026 and sent it to the Sejm on 9 April 2026 as print no. 2443; it sets up KRiBSI, a Social Council for AI, complaint handling, binding individual opinions and sandboxes.

  2. Draft 2030 AI policy under consultation

A draft Council of Ministers resolution on the 'Policy for the development of AI in Poland to 2030' (replacing the 2020 policy) was in regulatory impact assessment and consultation in April-May 2026; no adoption date was found.

  3. Act signed and published; staggered entry into force

The President signed the Act on 24 July 2026; it was published on 27 July 2026 (Dz.U. 2026 poz. 1003). Per the official ELI record it entered into force on 11 August 2026, with Art. 125(4) from 28 July 2026 and Articles 8-18 plus Chapters 3-5, 8 and 9 (inspections, proceedings, penalties) from 28 October 2026. Parliament removed KRiBSI's power to issue withdrawal orders from the final text.

  4. Sejm appoints Pamela Krzypkowska as KRiBSI chair; Senate consents

After a 15 September 2026 public hearing the Sejm elected the former Ministry of Digital Affairs director as KRiBSI chair (271 for, 24 against, 140 abstentions; exact vote date not confirmed) and the Senate gave consent by resolution of 24 September 2026, published in Monitor Polski on 25 September 2026 (M.P. 2026 poz. 946).

  5. Senate consent published in Monitor Polski

Senate resolution granting consent to the appointment of the KRiBSI chair under the Act of 3 July 2026, the formal step that lets the commission be constituted within the three-month statutory window (by November 2026).

Analysis

After a long drafting history (a first ministry draft circulated in late 2024), Poland moved quickly in 2026: cabinet adoption on 31 March, Sejm print 2443 in April, passage over the summer, presidential signature on 24 July and publication on 27 July 2026. The Act of 3 July 2026 on AI Systems is a comprehensive implementing law covering supervision of AI systems and GPAI models, infringement proceedings, accreditation and notification of conformity assessment bodies, innovation support and administrative fines. Its centrepiece is the Komisja Rozwoju i Bezpieczeństwa Sztucznej Inteligencji, an independent collegial regulator serviced by the Ministry of Digital Affairs and including representatives of the competition, financial, broadcasting and telecom regulators.

Institutional build-out followed the statutory clock. The chair had to be appointed within two months of entry into force and the full commission within three; the Sejm elected Pamela Krzypkowska in mid-September 2026 and the Senate consented on 24 September, so the commission should be constituted by November 2026. Crucially, the official ELI record shows that Articles 8-18 and Chapters 3-5, 8 and 9 - the inspection, procedure and penalty machinery - only enter into force on 28 October 2026. As of 21 October 2026 Poland therefore had an enacted law and a named regulator but, for one more week, no operative national sanctioning power.

The readiness score reflects that sequencing. Poland now sits ahead of most large member states (Germany, France, Spain, the Netherlands) because its law is enacted and its regulator exists, but behind Slovenia and Malta, where enforcement has been legally available since 2025 or August 2026. Parliament also narrowed KRiBSI's toolbox by removing withdrawal/ban orders from the final text, which means product-recall-type measures will have to be routed through other authorities. The sandbox - free for SMEs, with technical preparations under way - and the still-draft 2030 AI policy are the next milestones to watch.
