EU AI Act implementation, 2026
Denmark was the first member state to enact an AI Act implementing law (Law No. 467 of 14 May 2025, in force 2 August 2025) designating the Agency for Digital Government as coordinating market surveillance authority, notifying authority and single point of contact; a fuller replacement 'AI-loven' lapsed with the spring 2026 election but was re-introduced as bill L 3 on 7 October 2026 with first reading set for 5 November 2026.

Key findings
- Denmark met the 2 August 2025 deadline with an enacted statute; the Commission lists the Agency for Digital Government as single point of contact without a 'pending' flag.
- Three market surveillance authorities operate under Law 467/2025: Digitaliseringsstyrelsen (coordinating), Datatilsynet (personal data, prohibitions) and Domstolsstyrelsen (justice).
- Penalties are in place via Law 467/2025 (criminal fines); the pending AI-loven would shift to administrative fines and add complaints and incident-reporting procedures.
- The replacement AI-loven was derailed by the March 2026 election and missed its planned 2 August 2026 start, but was re-tabled as L 3 on 7 October 2026.
- The joint Datatilsynet/DIGST AI sandbox has published case reports from completed rounds; the December 2024 Strategic Approach to AI is the current strategy.

Analysis
Denmark treated AI Act governance as a sequencing problem and solved the first step early: a short 'temporary' law in May 2025 that named the authorities and gave them enough powers for the prohibitions, GPAI and transparency phases. That choice is why Denmark is one of only a handful of member states with an unqualified entry on the Commission's authority list, and it meant the 2 August 2025 and 2 August 2026 milestones arrived with a functioning regulator in place.
The second step, a comprehensive AI-loven, has been the victim of electoral timing rather than policy disagreement. L 111 had a first reading scheduled for 17 March 2026 when the spring election intervened; Danish bills lapse automatically at dissolution. The 69-day government formation pushed re-introduction to the opening of the 2026-27 session, where L 3 now sits with cross-party support likely, given the uncontroversial passage of its predecessor. Its main additions are a formal citizen complaint right, incident-reporting duties, administrative fines and ministerial power to designate further sectoral authorities.
Operationally, Danish regulators are ahead of their legal mandate. The Datatilsynet-DIGST sandbox has produced published case reports, DIGST runs a standing implementation working group with stakeholders, and DIGST has been updating guidance for the Digital Omnibus. With Annex III high-risk duties now postponed to December 2027, the delay to the AI-loven carries little practical cost, and Denmark remains a reference model for small-state implementation.
